This Privacy Policy (“Policy”) describes how NovamindAI LLC (“FyneSite,” “we,” “us,” or “our”) collects, uses, discloses, and protects your personal information when you access or use the FyneSite platform, website, and all related services (collectively, the “Services”). By using our Services, you consent to the practices described in this Policy. This Policy is incorporated into and forms part of our Terms of Service.

1. Information We Collect

We collect information in several ways when you use our Services:

1.1 Account Information

When you create a FyneSite account, we collect:

  • Your name and email address;
  • Account credentials (passwords are hashed and never stored in plain text);
  • Profile information you choose to provide; and
  • Organization or business name, if applicable.

1.2 Payment Information

When you subscribe to a paid plan, payment processing is handled entirely by Stripe. We do not store your full credit card number, CVV, or other sensitive payment credentials on our servers. We receive and store:

  • Billing name and address;
  • Last four digits of your payment method;
  • Subscription plan and billing history; and
  • Stripe customer and subscription identifiers.

1.3 Website Content

When you use our AI website builder, we collect and store:

  • Text, images, media, and other content you upload or create;
  • Website configuration, settings, and design preferences;
  • Custom domain information; and
  • Prompts and instructions you provide to our AI generation tools.

1.4 Usage Data

We automatically collect certain information when you interact with our Services:

  • IP address and approximate geolocation;
  • Browser type, operating system, and device information;
  • Pages visited, features used, and actions taken within the platform;
  • Referring URLs and search terms;
  • Date, time, and duration of visits; and
  • Error logs and performance data.

2. How We Use Your Information

We use the information we collect for the following purposes:

2.1 Providing and Improving the Services

  • Operating, maintaining, and delivering the FyneSite platform;
  • Processing your transactions and managing your account;
  • Hosting and serving websites you create; and

2.2 AI Website Generation

  • Processing your prompts and instructions to generate website content;
  • Sending relevant data to third-party AI providers to produce text, layouts, and design elements; and
  • Improving our AI generation capabilities using de-identified or aggregated usage data.

2.3 Analytics and Optimization

  • Understanding how users interact with our platform;
  • Identifying and fixing bugs, errors, and security issues; and
  • Measuring the effectiveness of our features and services.

2.4 Communication

  • Sending transactional emails (account confirmations, billing receipts, security alerts);
  • Providing customer support and responding to inquiries;
  • Sending product updates and announcements; and
  • Marketing communications (with opt-out available at any time).

3. Information Sharing

We do not sell your personal information. We share information only in the following circumstances:

3.1 Third-Party Service Providers

We work with trusted third-party services that help us operate the platform:

  • Firebase (Google): Authentication and user identity management;
  • Stripe: Payment processing and subscription billing;
  • Amazon Web Services (AWS): Cloud hosting, storage (S3), database services (RDS), and content delivery;
  • OpenAI and Google AI: AI-powered content generation for website building; and
  • Email delivery services: Transactional and marketing email delivery.

These providers access only the data necessary to perform their functions and are contractually obligated to protect your information.

3.2 Legal Requirements

We may disclose your information when required by law, regulation, legal process, or governmental request, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.

3.3 Business Transfers

In connection with a merger, acquisition, reorganization, or sale of assets, your information may be transferred as a business asset. We will notify you of any such change and any choices you may have regarding your information.

4. Data Security

We implement commercially reasonable security measures to protect your data:

  • Encryption in Transit: All data transmitted between your browser and our servers is encrypted using TLS/SSL;
  • Encryption at Rest: Sensitive data is encrypted at rest using industry-standard encryption;

  • Correction: You may request that we correct inaccurate or incomplete personal information;
  • Deletion: You may request that we delete your personal information, subject to certain legal exceptions (e.g., data required for legal compliance or to complete a transaction);
  • Data Export: You may request an export of your data in a standard, machine-readable format (e.g., HTML, JSON, or ZIP archive); and
  • Opt-Out: You may opt out of marketing communications at any time by clicking the unsubscribe link in our emails or contacting us directly.

5.1 California Residents

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect and how it is used, the right to request deletion, and the right to non-discrimination for exercising your privacy rights. We do not sell or share your personal information for cross-context behavioral advertising. For details, see Section 9 of our Terms of Service.

6. Cookies and Tracking

We use cookies and similar technologies to operate and improve the Services:

6.1 Essential Cookies

These cookies are strictly necessary for the platform to function. They include session cookies that maintain your authenticated state and security tokens (e.g., CSRF protection). You cannot opt out of essential cookies while using the Services.

6.2 Analytics Cookies

We may use analytics cookies to understand how users interact with our platform, measure feature usage, and identify areas for improvement. Analytics data is collected in aggregate and is not used to personally identify individual users.

6.3 Preference Cookies

These cookies remember your preferences, such as language settings, theme selection, and editor configuration, to provide a personalized experience.

6.4 Managing Cookies

You can control cookies through your browser settings. Disabling certain cookies may limit your ability to use some features of the Services. We do not use cookies for third-party advertising or cross-site tracking.

7. Website Content Ownership

You own the content you create. FyneSite does not claim any ownership rights over the websites, text, images, media, or other content that you create, upload, or publish using our Services.

  • You retain all intellectual property rights to your website content;
  • We do not use your website content for training AI models without your explicit consent;
  • You grant us a limited license to host, display, and serve your content solely for the purpose of providing the Services; and
  • This license terminates when you delete your content or close your account, subject to our data retention policies as described in our Terms of Service.

8. AI-Generated Content

FyneSite uses artificial intelligence to help you build websites. Please be aware of the following regarding AI-generated content:

  • AI Limitations: Content generated by AI may contain inaccuracies, errors, or unintended outputs. AI-generated text, layouts, and design elements are provided as a starting point and should be reviewed before publishing;
  • Your Responsibility: You are solely responsible for reviewing, editing, and approving all content published on your website, whether created manually or generated by AI;
  • Third-Party AI Providers: We transmit your prompts and relevant context to third-party AI providers (including OpenAI and Google) to generate content. These providers process data according to their own privacy policies and data handling practices; and
  • No Guaranteed Uniqueness: AI-generated content may be similar to content generated for other users or content that exists elsewhere. We do not guarantee that AI outputs are unique, original, or free from third-party intellectual property claims.

9. Children’s Privacy

FyneSite is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will take steps to delete that information as promptly as possible.

If you are a parent or guardian and believe your child has provided us with personal information, please contact us at support@fynesite.com so we can take appropriate action.

10. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will:

  • Post the updated Policy on our website with a revised “Effective” date;
  • Notify you via the email address associated with your account; and
  • Provide at least thirty (30) days’ advance notice for material changes.

Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Policy. If you do not agree with the changes, you should stop using the Services and close your account.
